Bingo Sleep is a mobile application owned and operated by Eric Miller Design, Inc. (“we,” “us,” “our”). By using the Bingo Sleep app ("Bingo Sleep" or "the app"), you agree to the following Terms of Use.

Use of the Bingo Sleep iOS app is also subject to the Apple Standard End User License Agreement.

Please read the following carefully. If you do not agree with these terms, please do not use our app or website.

1. Use of the App

Bingo Sleep is a mobile app designed to help users fall asleep to the calming sounds of bingo numbers being called along with background noise. The app is intended for lawful use. The app is provided for personal, non-commercial use. You agree not to use it for any illegal, commercial, or harmful purpose.

You agree not to use the the app or related services:

• For any commercial, illegal, harmful, or abusive activity.

• To copy, reverse-engineer, or interfere with our software or services.

• To misrepresent your identity or violate others' privacy.

We reserve the right to suspend or restrict your access to certain features or services at any time if we reasonably believe you have violated these Terms.

2. Ownership and Intellectual Property

All content, designs, code, and materials in the app and on the website are the property of Eric Miller Design, Inc. or its licensors. You may not copy, modify, or distribute any part of Bingo Sleep without our prior written permission.

3. Content

The Bingo Sleep app uses built-in audio clips and only collects user settings, saved on the user's device and/or iCloud account.

Bingo Sleep provides relaxation audio designed purely for wellness and entertainment. It is not intended to diagnose, treat, or cure any condition.

By using the app:

• You are responsible for how you use the app.

• We make no guarantees regarding the accuracy, originality, or appropriateness of content.

• You are solely responsible for reviewing and using the app. We are not responsible for any results, decisions, or outcomes that arise from your use of the app.

  
  

Data Storage and Availability

All information you enter into Bingo Sleep is stored locally on your device or in your personal iCloud account, as described in our Privacy Policy. Because we do not collect, access, or control this data, we cannot guarantee that it will always remain available. Data may be lost or become inaccessible due to software bugs, user actions, device failure, iCloud service issues, or other factors outside of our control. You acknowledge that lost data cannot be recovered and such data loss does not entitle you to any refunds, credits, or other compensation.

The app complies with Apple's privacy manifest requirements and declares UserDefaults usage for app functionality (CA92.1.1).

4. Privacy

We value your privacy. Please refer to our Privacy Policy for details on how we handle information submitted through our website or newsletter signup. We do not collect personal data through the app. Any information or preferences saved within the app are stored locally on your device and/or in your personal iCloud account under Apple’s control. We do not access or store this information on our own servers.

5. No Warranties

Bingo Sleep is a relaxation app only; it is not medical advice and does not diagnose or treat sleep disorders. Results are not guaranteed. If you have sleep or health concerns, consult a qualified professional.

Bingo Sleep is provided “as is” without warranties of any kind, whether express or implied. We do not guarantee results, reliability, that the app will be error-free, uninterrupted, or free from harmful components.

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose.

6. Limitation of Liability

To the maximum extent permitted by law, Eric Miller Design, Inc. and its affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app or inability to use the app.

7. Third-Party Services

The app or our website may link to or depend on third-party services, including Apple, Mailchimp, or others. We are not responsible for the content, security, or privacy practices of those services.

8. Subscriptions and Payments

Bingo Sleep offers optional subscription plans billed through Apple’s App Store. Payments, renewals, free trials, and cancellations are managed via your Apple ID account settings. Refunds are handled exclusively by Apple in accordance with their policies. We do not collect or retain any payment information.

9. Modifications

We may revise these Terms of Use at any time by posting an updated version. The “Last Updated” date above reflects the effective date. Continued use of Bingo Sleep after any updates constitutes acceptance of the revised terms.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New York, USA, without regard to conflict of law principles. You agree that any disputes will be resolved exclusively in the courts located in New York.

11. Entire Agreement / Severability

These Terms, along with our Privacy Policy and Apple’s Standard EULA, constitute the entire agreement between you and Eric Miller Design, Inc. concerning Bingo Sleep. If any provision is found unenforceable, the remaining provisions remain in effect.
